If the dispute cannot be resolved amicably, it may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time. The seat and venue of arbitration shall be Mumbai and the proceedings shall be conducted in English, unless otherwise agreed between the parties.
18. Mediation
In the event of any dispute, difference or claim arising out of or in connection with these Terms, the Website or any services provided by Cozee Home, the parties shall first endeavor to resolve the matter amicably through mutual discussions. If the dispute cannot be resolved through discussions, the parties may, by mutual agreement, refer the matter to mediation before proceeding with arbitration or other legal proceedings. The mediation shall be conducted by a mutually agreed mediator and in accordance with applicable laws of India. The parties shall be mutually agreed upon by the parties.
19. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of India. Subject to the dispute-resolution provisions above, the competent courts at Mumbai shall have jurisdiction over matters arising from or relating to these Terms, subject to applicable law.
20. Severability
If any provision of these Terms is determined to be invalid, unlawful or unenforceable by a competent authority or court, such provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall continue to remain valid and enforceable.
